Terms of Service

Our operating agreement is straightforward. It sets clear boundaries for using diglino.pro, protects your data, and defines our mutual responsibilities. Read it, understand it, and proceed with confidence.

A Simple, Binding Agreement

By accessing or using diglino.pro, you agree to be bound by these Terms of Service, our Privacy Policy, and any other policies referenced herein (collectively, "the Terms"). If you do not agree to these Terms, you may not access or use the Service. This is not a casual agreement; it is a legal contract between you ("User") and Diglino, a company registered in Poland ("we," "us," or "our").

These Terms govern your use of our website, which provides information, analysis, and editorial content regarding mobile gaming applications. Our Service is intended for users who are at least 13 years of age. If you are under 18, you represent that you have the consent of your parent or guardian to enter into this agreement. By using the Service, you affirm that you are of legal age to form a binding contract, or have received parental consent to do so.

Method Note: How We Enforce

This document is a living framework, not a static rulebook. We evaluate its robustness through three lenses:

  • Risk Profile: We prioritize preventing data misuse and copyright infringement. Terms are written to be enforceable under EU and Polish law.
  • Limits of Scope: We are an informational platform, not a marketplace or launcher. Our terms cannot govern app stores, publishers, or developers.
  • What Changes Our Mind: A significant ruling from a European court regarding user-generated content liability, or a fundamental shift in app store policies (e.g., Apple/Google), would necessitate a review.

Code of Conduct: The Boundaries

You are free to explore and critique, but you are not free to harm. These rules protect the community and the integrity of our platform.

Prohibited Use

You may not use the Service to:

  • Harass, threaten, or bully others.
  • Post illegal, abusive, or pornographic content.
  • Attempt to gain unauthorized access to our systems.

Your Content, Your Rights

When you post reviews or comments:

  • You retain ownership of your intellectual property.
  • You grant us a license to display and moderate it.
  • You are responsible for the accuracy of your claims.

Service Integrity

You must not:

  • Scrape data for commercial purposes.
  • Use bots or automated scripts to access the Service.
  • Impersonate other users or entities.

The Moderation Trade-Off

  • Downside: Strict moderation can feel restrictive and slow down community discussion.
Mitigation: We publish clear, transparent moderation guidelines and offer a simple appeal process for flagged content.
  • Downside: A permissive environment attracts spam and low-quality content.
Mitigation: We employ rate-limiting, automated detection for common spam, and a user-based flagging system to maintain signal quality.
  • Downside: Human moderators have biases and cannot operate 24/7.
Mitigation: We use a hybrid model: automated first, with human review for appeals and edge cases. All moderators are trained in Polish and EU law.
  • Downside: Distinguishing between harmful speech and robust critique is subjective.
Mitigation: Our policy prioritizes context. A review of a game's monetization is protected; a personal attack on the developer is not.

Accuracy of Reviews
Our reviews are based on testing and research. However, app stores and developers can change games overnight. We cannot guarantee all information is 100% current.
Third-Party Links
Links to app stores, developer sites, or social media are for convenience. We do not control these external sites and are not responsible for their content or security.
Service Interruption
We aim for 99.9% uptime but cannot guarantee uninterrupted access. Scheduled maintenance will be announced in advance on our Journal page.
App Performance
We do not develop or distribute the apps we review. We cannot be held liable for bugs, performance issues, or data privacy practices of third-party applications.

The Ground Rules: Assumptions & Constraints

Core Assumptions

  • Users are literate in English and understand basic gaming concepts.
  • The Polish legal system recognizes standard limitations of liability for informational websites.
  • Users are responsible for verifying app details before making purchases.

Critical Constraints

  • We cannot test on every device model or OS version.
  • We rely on publicly available data for app metrics (downloads, updates).
  • Monetization models can change without notice from the developer.

What Would Change Our View?

A formal ruling from a European consumer protection authority holding editorial sites strictly liable for third-party app claims would force us to fundamentally redesign our review process and disclaimers. We monitor such legal developments closely.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law principles.
